Under 49 U.S.C. § 521(b)(5) — the “#ImminentHazard” statute — Federal Motor Carrier Safety Administration has both the authority and the duty to immediately place an unsafe carrier out of service when continued operation poses an imminent risk of death or serious injury.
In my opinion, Hope Trans LLC meets that standard today.
Since the fatal Terrell, Texas crash — where the driver admitted to falling asleep while hauling U.S. Mail, killing five people, violations keep piling up and previous violations have not been corrected
According to public safety records https://ai.fmcsa.dot.gov/... this carrier has continued to rack up serious safety violations, including:
❌ Operating without proof of a periodic inspection (49 CFR 396.17(c))
❌ Tire violations — tread depth less than 1/32”, multiple leaks, underinflation without ATIS (393.75C, 393.75A-TAOL)
❌ Failure to correct defects noted on prior inspection reports (396.9(d)(2))
❌ Brake system defects — vacuum hoses restricted/abraded/chafed through outer cover-to-cord (393.45B2-B-VAC)
❌ No record of duty status / ELD required (395.8A-ELD)
❌ False HOS reports (395.8E-HOSPD)
❌ Failure to review and certify ELD records (395.30B1-ELDDFR)
❌ Speeding — 11–14 MPH over the limit (392.2-SLLS3)
This is after killing five people.
This is after public outrage.
This is after national news coverage.
